Long story short, I picked up some undocumented workers to work on a deck. They did a great job. I agreed to pay $100 dollars. They then at the end of the job asked for payment. I asked to see their SSN, so I could report this information to the IRS. They said they didn't have one. I told them that I couldn't pay them without documentation. They became upset and yelled out RAWYER, which I think they meant lawyer. I threw them out of my house. If they come back, can I just give them a set of used clothes and tell them the debt has been paid?

You answered your own question. You agreed to pay them $100, therefore you owe them $100. You knew they were undocumented workers, so you knew they wouldn't be able to give you an SSN number when you hired them. You knew full well you were entering into a bargain illegally. The least you can do is be fair and hold up your end of the bargain.

You can find such people outside every Home Depot. They help you in loading unloading and miscellaneous jobs. You pay then in cash and never ask for social security number. Everyone knows that they are there.

Long story short, they may be allowed under some arrangement/law/understand. But what you are doing in illegal. You knowingly picked undocumented workers.

My friend, you have opened a can of worms. Those undocumented workers CAN report YOU to I.C.E. (Immigration and Customs Enforcement) as one who harbors and/or is sympathetic to undocumented workers. By the time you get through with the 'exam' (sound of rubber glove over lubricated fist) you will be in front of a federal judge. Hate to tell you, but the IRS will be the least of your problems at that time. God don't like ugly...and he ain't too thrilled with pretty.

What you did was immoral, not to mention illegal. First of all, you are not allowed to hire them BEFORE asking for their proper documentation. If you hire them without checking, then you have just broken the law. All employers must check before hiring. Secondly, they did the work, they deserve to get paid. You screwed them out of their money based on a lame excuse. You already broke the law when you hired them, so why not pay them? I think you KNEW damn well these guys were illegal and hired them anyway so you could take advantage of them. You better hope they don't come back and take alot more than your clothes you cheap bastard.

In this situation you are not required to report anything to the IRS. The issue of their immigration status is separate from your obligation to pay your debts.

In your situation I'd be more concerned with their making a "midnight raid" on my new deck and less concerned about their contacting a lawyer. Enjoy your new ash pit.

2 wrongs do not make a right,. Pay them what they earned, then do not hire illegals again. You are in effect stealing their services even if they are here illegally. And if the ACLU gets hold of it you could face a suit that they will have no legal fees assessed to them, nut you will have to employ legal council or failing to respond in court, will loose by default.

So in effect you are willing to steal from lawbreakers (illegals). What does that say about your morals or ethics? Are you superior or just a guilty as lawbreaking? For what it may be worth, a quote to consider: "Do unto others as you would have them do to you." Jesus Christ

You should pay them for their work. That is the only honest thing to do. Otherwise you are stealing from them.

If you did not realize they were undocumented that was your fault for not asking for credentials before hiring them.

Give them the money, don't be a crook.

In reality, you should have checked before you allowed them to do the deck. If you think they are illegal, report them. If they come back, call the police.

Under the circumstances they were household employees (think nanny tax) for whom social security withholding is not required unless they are paid at least $1,500 per year.
