I know a kid who's parents went through a divorce and his step dad (the only dad he ever knew from 8 months old) took away his last name (when the boy was 15) claiming it wasn't "a legal adoption" and the boy wasn't acting like a (last name) -he wasn't handling the divorce so well. I believe this man with drew this boys identity the only name he ever knew. Interesting however, this step dad was adopted and his last name isn't even his by blood. I don't get how someone can do this to a child.

This kid doesn't want the last name unless it is given to him.

any one has the right to change their name
to which ever name they desire

Legalities do not form or break a person. What is greater than that is the emotional rejection that this poor kid is facing. Kids will blame themselves and internalize truamatic situation even without non sense like this. I am hoping there is counseling involved or else this kids thoughts are going to be that of worthless, rejected, fear of abandonment etc. At 15 an adolescent's brain is changing, not to mention the hormones and growth and social aspects of life. Please if you are close to this family suggest counseling so that his irrational thoughts can be funneled and he can finish his teen age years knowing how significant he is. His "father" figures actions- nobody can control that- What we can control is how we react/grow and learn from it. Prayer works too!!!

unless the guy did legally adopt the boy, yes he can take the name. but the boy shouldnt have been able to use his stepdads name unless it was legal-for tax purposes and school records. i feel sorry for the boy losing the only thing he knew.

if your friend's last name was LEGALLY the same name as his step-dad's, to "take it away" the step dad would have to file papers with the court and pay a fee to change it.

your friend probably needs to check with the local court to see if something was filed by step dad to legally change his name.

if not, he probably has the same name he always did.
