I had been involved in a car accident today, while i was driving with the speed limit, wearing my seatbelt with my kid in her car seat, this lady did not stop at the red light and hit me.It was pretty bad and we survived only because the car I had was a good one, all the airbags popped, front and side curtains.I had a Hyundai Sonata 2007, the car was 1 month and a half old, only 3000miles on it.The lady that hit me has car insurance, i have it to, we are waiting some answers now, but i was wondering if someone knows if i can get my new car back?So far it seems yes but you never know, the good thing for me is that there were witnesses that signed a report saying she did not stopped at the red light.

Did you happen to hear about the New car replacement insurance with Allstate?...If your car is deemed a total loss and is within I believe 2 years you will be able to get another car at the rate the cars are at currently for the same type....Speak with an allstate agen to get the details...

Anyways back to your ?...To be considered a total loss it will all depend on the value the car, and how your insurance company conducts their value assessment, the best in my opinion is actual cash value..The disadvantage to this is it does not take into consideration a person who financed the vehicle at a ridiculous rate, who did not have a good purchase price to begin with or someone who is upside down on the noted..In this case not knowing the facts and you personally..You probably ar epside down on your notes, meaning you owe already more than the car is worth..For example lets say that you probably still owe over 22,000 for the car and it's current value is only 18,000... I also drive a Hyundai Sonata 07 gold named my lil baby :). Anyways our cars have a low resell value sorry but they do, however as you stated they have a lot of safety devices that make the car more expensive to repair and more likely to be a total..You do need to get an estimate..the total amount of a vehicle will include all property damage involved, the car seat if damaged as well as your loss of use and rental need..Based on the repair amount and actual cash value the car may be deemed a total loss...If you did not know, you also get to recover what is called diminished value since obviously this car has value since it is newer and was involved in a not at fault accident. If you have any upgrades be sure to explain that to the adjuster who, if it will be totaled by, these upgrades. You may have to prove these upgrades and the cost and that is easy to get from the dealer as well as service records which also show condition of upkeep.

Some insurance companies may total loss a current year model vehicle at less than 75%.

If the insurance company thinks the car is repairable - they may have you take it to a shop and have it torn down (take damaged parts off of it) so they can see any hidden damage. Sometimes you have to do this before you decide if you should repair or total a car.

The best thing to do is talk to the adjuster that is handling your claim. Once they get the estimate, they will be able to tell you what the next step is.

we cant predict this. New cars are very difficult to total. Ive seen rollovers repaired several times.

Its simple- if it cost more to repair then replace... it will be totalled. if it cost less.. they repair it.
