That is a hard question. If he has custody of the child then I would say yes definitely but if there is no custody agreement then that makes it hard to hold this person legally responsible. Yes, but whether it actually happens depends on many factors. Years back, my ex tried to sue me for support for her 2 children during a divorce dispute. The problem was, she had already been awarded support from her previous husband, the father of the children, but wasn't collecting When I pointed this out to her lawyer, he said somebody had to pay, and since he wasn't it was up to me. I pointed out to the judge I accepted the expense of raising the boys while we were together, but she still had an enforceable order on the father, and if she went man to man, technically she could have half a dozen orders, and decide to enforce them all. The judge agreed and told the lawyer he was being unethical, and threw it out.
Mind you, this same lawyer tried to sue me for half the value of the famiy home, which we had lived in for only months, carrying a 100% mortgage. I pointed out to the court our equity, the amount actually paid off on the loan, in the home at time of split was just over $100. She could have her $50 any time.
