I am a firm believer in controlling illegal immigrants and the deportation of ALL people deliberately here illegally. However, after reading the story at the link, I feel that this one case that needs special consideration by the government. The lady in question did not come here to deliberately break our laws and the problems that have come about have done so out of ignorance of the consequences of her actions in getting married.
It would have been easier all the way around if the couple had waited the six weeks necessary for the woman to obtain citizenship with her mother under the original political asylum ruling when the immigrated from Guatemala, but they probably didn't realize the problems that would arise from the marriage.
Laws are made to be upheld, but waivers can be granted due to special circumstances. The circumstances of this case, I believe, warrant a waiver and a grant of at least another year for the lady in question to obtain her citizenship. After all, she was merely six weeks away from getting it as an unmarried daughter under 21 of a legal immigrant.

In my opinion, she came here because she followed her mother and depend on her mother so that she was not a criminal. Many of immigrants are not educated enough with the immigration law and I am sure many of citizens are the same. One of the immigration law said once a foreign marry a US Citizen, the visa status become available immediately, because she/he is consider as a family member regardless their status (legal/illegal). There is also process a visa waiver program which mean Gov can waive their illegal status. The important is about marry someone in a good faith, I don't think he brake the law to marry illegal, there is no law saying that you can not marry certain people, even you can marry someone in jail that obviously criminal. They should find a good lawyer.
I am sorry that I do not agree that her husband who in combat zone deserve punishment.. hey people? where is your heart? what happen if you don't have US Soldier anymore who fight for this country because they get treat badly? I wish you know how the GREAT feeling if you are in the combat zone!!!

My grandfather was stationed in Germany where he meet my grandmother who is 100% German. She wasn't allowed to immigate over here just because she married a man serving in the arm forces. She had to become a citizine of the USA the same way that everyone else did. While I have so much respect that he risk his life to protect the rest of us,if she didn't come over here legally, then she should be deported.

Those serving in the military are not above the law nor should they be, I don't think they should have to deal with this while they are deployed in a combat zone but they are not above the law.
The case you are talking about is a hard one because she was a few weeks from being legal when she married her husband. I wish they would give more details for example was mom and daughter aware that by marrying she would be giving up her chance at legal status. If she knew and still married him then she knew she was risking legal status.
Its a sad case and needs to be looked at by immigration officials - the mom did what she should to become legal but unfortunately the daughters marriage was really bad timing. It seems we may need to simplify or make more clear the legal process BUT ultimately it is up to the individual to know the law, especially when it concerns something this important...

Read the story people. She is not from Mexico, and she is and always has been here legally. The problem is that our "system" took four yeas to process her mothers paperwork. I thought I had read somewhere that the immigration authorities had the option to grant these cases if the child met the requirements when the paperwork was filed, even if they "aged out" while is was being processed. Seems you could do the same thing here.

I can't fathom why she didn't get her status before getting married. Why didn't she just wait a little longer? Dirty(er) Martini has a point. It's all so paper thin in this case.
If a soldier knowingly marries an illegal alien and tries to use military service as an excuse to get away with it, that's unexcusable and the spouse should be deported.
This case is wierd.

i think that this is necessary.. Our economy is down. We cannot afford losing jobs to illegal immigrants who are underpaid anyway and on top of that commit crimes. we dont have the money to deal with illegal immigrant criminals and we dont have the money to not employ our own citizens. Good job Obama.

Hum, looking at the cold hard FACTS -- she's breaking the law and shouldn't be here, he knew she was breaking the law and they didn't do anything about fixing that important item, law are suppose to be followed, if you allow her to be an exception to the law, how many millions will claim that they should be granted asylum/amnesty....
She should definitely be deported! She shouldn't be here! What part of ILLEGAL is so hard to understand?
I know it sounds hard hearted since her husband is serving our country. If she gets deported, she has no one to blame but herself. SHE BROKE THE LAW!
