My Boss is taking out Taxs from my pay check but not paying them. What can I do? Will this come back on me?

I know at times he don't send in the tax's for one I'm the administrator for the comp. I know also he had to pay a $13,000.00 fine from doing this same thing back in 2004. I have been looking for a job. I have worked for this company for just under 2 years now and this Fri will make the 4th time he didn't have money for payroll in the time I have work for him. We are a small company only 7 people. I cant quit till I have a new job. Also yes I keep all my stubs. He pays with check. Thanks for your info.

Make sure you keep your pay statements. If IRS come down on your boss before he issues your W-2s he may go out of business and not bother with them. Your W-2, besides being your wage and and withholding statement, is also the input document for crediting your Social Security retirement account for wages you have earned. Every year Social Security sends workers a statement of reported earnings to date. If yours from this job don't show up, you will need documentation to prove you had the earnings otherwise your retirement benefits will be reduced for life.

Is he giving you a pay check or statement showing withholding? Or just paying you cash and telling you he is paying you less because of taxes?

In the first case, there is no way he won't get caught. In the second case, he is cheating you as well as not paying taxes.

You need to find another job.

You could also report him to you state wage and labor board if you want, after you get another job.

This won't hurt you at all. Your boss, however, has a major problem on his hands as the IRS takes an extremely dim view of employers holding onto trust fund monies and not paying them in.

There's a strong chance that the IRS will seize your boss' business and assets over this. I've been locked out of jobs twice over this in my lifetime. Start looking for a new job NOW!

how do you know he is not making the required tax deposits??
No, if they are taken out, he will be responsible to pay them, Not you.
