My father passed away recently and now his mother is very ill as well. The will with my father was a sticky situation with my mother, who none of us get along with very well. In my grandmothers will, she has left everything to her two sons equally. My mother says that my fathers half will go to her and not to his descendants. Ive been told that it goes straight to his surviving descendants but can not be sure. This is not a selfish situation on my behalf, i am just trying to protect my disabled sister from being stung again. Thanks for any help.

Been in these shoes. I don't know if it is different in other states but where I live, the father's inheritance will go to his offspring not to the mother, the only way the mother could get anything would be if she is still raising young children. How old is your disabled sister anyways? If you have to get an attorney get one but most attorneys will give you legal advice free of charge.

Where do you live? Even in the US, these laws vary by state. In some states if a person dies without a will everything goes to the spouse, but in other states it's divided between the spouse and the children.

Sorry about your lose. What i know it does go to the both party's and the will should say that. There are ways to fight it if you wish too for your sister. I understand what you mean i would feel the same way cause my son is disabled too. All the best to you and your sister.

I am pretty sure that your mother gets the money. The only way that it changes is if the father had children from another marriage, then the money is split b/t his new wife and his children.
