If the uncle is:
married into the family i.e.
If the uncle father's sister's husband

The mother's brother, and she changed her name when married

If the uncle changed his last name

If the child keeps the maternal name of the 'married in' relative

i know my phrasing is bunk, sorry if this is too confusing

Well lets see, my uncle curly is Nichols, I am not nor was i ever. This happens when your aunt who is your mom or dads sister is married to the man who then becomes your uncle. OR if your uncle is your mom's brother, more than likely they have different last names, if she got married before having kids anyways.
