You can debate all day whether or not you think the punishment for the crime was the appropriate one, but how does that have anything to do with immigration? Him being illegal is irrelevant to the crime and the sentence. Him went through the court system and the Judge/Jury convicted him, just as they would any other murderer.
The family that he killed was also illegal. Does that change anything? No. Just as his legal status doesn't change the horrendous things that he did.
He will now die in America, behind bars.

I'd like to know why he wasn't deported in 2003, when he was convicted of a battery charge.

Rios told police that after he got home from work about 1:30 a.m., his wife had started arguing with him about doing chores around the house. Rios got angry, grabbed a steel pipe, and hit his wife in the head with it. Then he grabbed an extension cord and strangled her with it. He then grabbed his 20-month old baby daughter Thannya Karolinna and strangled her with his bare hands. He used the extension cord to strangle his other two daughters, 4-year old Katherinne and 10-year old Liliana. After killing his family, Rios carried the bodies of his children into the bedroom and placed them on the bed. He then dragged his wife’s body into the bedroom.
Alejandra Gutierrez was reported missing on December 8, 2005 after not returning home from school that day. Her mother watched her walk down the street towards her school bus stop at approximately 9:50 a.m. and that is the last time anyone saw her alive except for her alleged murderers. Extensive searches of the area failed to locate Alejandra.
While incarcerated in the County Jail, Simon Rios indicated to authorities that he knew where they could find the body of the then missing 10-year-old Alejandra Gutierrez. As it turns out Alejandra had been a classmate of Rio’s daughter the previous year. The Rios home was also located two houses from Alejandra’s bus stop.
Rios eventually told authorities that he and seventeen-year-old Juan Rosales dragged Alejandra into his van. Juan Rosales raped Alejandra, and then he raped her. They eventually dumped her body in a remote location in another county. Her body was located based on the information given to authorities by Rios.
There should not have been a plea bargain, this is surely a death-penalty case if there ever was one.

Ten years was not enough. Eligible for parole in far less. By this illegal aliens' track record, if paroled, he will violate it, run back to Mexico, hide out and come back. If deported following release from prison, odds are he'd lay low, slip back across the border. He is a prime example of the criminally-intent illegal aliens. One of Arkansas Senators Blanche Lincoln voted for shamnesty, and voted against the amendment in the bill to bar the criminal illegal aliens. In the face of incidents like these across the nation, it is appalling that many Senators did not want to forever ban this type from the US. ICE should be waiting for him to be released, several times illegal now, but since he probably would sneak back in, this is more cause for thoroughly securing our borders.

More senseless killings that would never have taken place if that illegal criminal alien were not in this country.
Round them up and deport all...

He should be put to death, so we don't have to pay for him to be kept alive.
