I got behind on a school loan bill and got a letter saying I'm about to go into default and that they will garnish my wages and take my tax returns. Well, I don't work, so I have no wages, nor do I get a tax return. My question is will they take my husband's wages and tax returns? Has this happened to anyone else?

oh, I hope not, we were keeping our finances separate, but I got behind and don't want it to effect my husband's credit score. We file taxes separately, but I don't understand that part too well, If anyone knows more let me know please.

Oh No, they can not take your husbands wages for something that was soley yours to begin with. you can easily catch up, just start sending them payments or make arangements with them. Call asap though. it will hurt your credit. Also you can easily tell them that you are going through difficult times right now and you need a deferment, if that doesnt work ask for a foreberance. But they will work with you if you let them know you need help. just dont get behind and expect it to all go away. Also make sure he files his taxes alone. Anything that has your SSN on it they can take possession of.

That is separate. As long as the loan is separate, it cannot be part of your husband's IOU's. I had a bankruptcy, but my wife was not involved.

The student loan cannot be considered joint.

But they might take a shot at your tax return. My suggestion is to make sure that you owe on the return, and not pay too much in to get a refund. In other words, claim extra exemptions. That way they can't attach any refund.

No but they can take tax return. U can file separately but its higher taxes or file jointly n file an Injured Spouse Form 8379. If tax refund is intercepted. The IRS would determine the amount of refund due each spouse, n the non-garnished spouse would receive their portion of the tax refund.

Not his wages, but they can seize his tax return if you two file joint returns.

Try and work out a deal with the organization that hold the note, make arrangements and see what can be done.
