Can I get charged for driving drunk in the state of louisiana?If i didnt get charged at the scene and no one got hurt but me?

I got in a wreck . I loss control of my veichle and flipped it. The cops kept asking me if i was drunk but I know I was and i told them no. I just had 3 beers which is pass the achool limit. They took me to the hospital and asked me again if i was drunk.And then took a blood sample, but they only gave me a ticket for careless operation. Can they are will they charge me with drinking and driving? if they already issued me a ticket? for carless operation and thats it? I mean I thought when you are drunk.and they catch you. You get arrested right there and then? please answer

Additional charges ca be placed if the sample is sent to the Police lab, and it comes back positive for over the legal limit, drugs, combination, etc.

Think of it this way. They can't arrest you without proof. The proof is sitting on a shelf somewhere waiting to be tested. Once they have the proof, they can then charge you. Being immediately arrested for DUI is only to lock you up a few hours until you are sober. The big problem comes when you get the citation and go to court.

What was you thinking anyways of drinking and driving?! dont you know that you could have killed yourself or worse some innocent bystander because you was too cheap to call a taxi... Why not? If you murder someone and you don't get arrested there and then, can they charge you with murder at a later time? Of course. All they need is enough evidence. They may not bother pursuing it, but nothing can prevent them form doing it.

you got what we call in louisiana a break, chances are you were in a corporation when you got this violation, corporations dont get money for dwi's, so they give careless operations, now that you been given tickets you shouldnt have to worry about getting a dwi, but in most cases a careless operation ticket is the closest thing to a dwi as far as for driving records, hope this helped
