No states REQUIRE employers to provide health insurance. If an employer chooses to provide it, they aren't REQUIRED to offer family coverage. If they CHOOSE to offer family coverage, a few states require that they include a declared domestic partner if there is a qualifying event.

SO. You'll have to ask your HR if you can add a cohabitating declared domestic partner, and if you can, you have to wait until open enrollment. And if you can't, then you can just marry him, which is a qualifying even to change coverages now. Keep in mind, though, most employers charge EXTRA if you add a spouse, that has insurance available through his job. So the savings might not be as much as you think they are.

The NJ law covers spouses and partners with a recognized civil union. UPS just made the news because they did not extend health insurance to gay couples with a state sanctioned civil union. They had to change their policy after the governor said they wanted all official spouses covered.

So, no, the law does not extend your coverage to your fiance. However, your employer might so check with your HR department.

Once you get married - you should be able to cover him. Until then, he's just a roommate your sleeping in the same bed with. He has the same legal rights that any other roommate would have (very little). Shacking up is fun - but it's not the same as marriage. Once you enter into the marriage contract, things change.

I am fairly certain he can be covered. You need to ask your HR dept. Some companies determine who must carry coverage by their birthdays (the earlier in the year is the primary carrier).
