Yesterday While At work I encounter a Rude Customer He was sweering at me about Cigarettes I told Him we didn't Have. The he started call me Bad Names I told He I Dont Know About these Cigarettes and He said Well Your a** works here i said Sir Have A nice day I'm Not Gonna Serve you then He said F**k You you are Then I said No I'm Not He said the is Bull I said Have A nice Day Then he asked for my Name I gave it to Him. Then I went Over to continue to Stock Cigerattes and He spit On me I went Ballistic I went out Side took A picture Of his License Plate and Called the Police The Police Basicaly Didnt do Nothing Told Me the Usual a Detective will Contact you about the Matter But hat Is None the Less a Person Spit on me. When I call the Boss and Told Him what happen he then Said to me Why R u turning Customers away I said You think I'm Gonna Degrade myself and still serve him after he was Curse me NO He said I could have serve him and this wouldnt happen Im still really Pissed off HELP

I was thinking on starting a petition anyone have any ideas about how to go about this and the police call it an assult but arent really pushing it.. If I do start a petition it will hopefully open the eyes of the city i live in and push the emploers to see that this is something really serious

I did ask the police what he would do and he said he'd have lost his job that day
alot of people said i was more smart not to hit him and that i should file charges then file a lawsuit

I have to get the report and that is the problem it's sad i gave them the license plate number and all and they still sitting on it if my husband would hae hit me and i call the police they wouldnt want to hear it they would have locked him up no questions so im wondering why anit nothing beinng done about this i went to the police station and the police officer said that simplae battery we dont follow up on that so what have you would have follwed up on me beating his a** and that is it but i promise u this the next person won't be so lucky to see me turn the other cheek

Some states will consider spitting on someone an assault. Especially since there acre some diseases that are communicable by saliva.
If you spit on a cop, you're charged with assault.

You need to check into the laws of your area, that would be considered to be an assault where I live.
You were smart not to retaliate and keep your cool through the whole thing.
You should contact a lawyer as well, as this assault could turn into something more. I don't want to scare you, but a woman that is one of my neighbors had something similar happen to her in the fast food restaurant that she managed,and the guy proceeded to stalk her and attempted to abduct her after work one night. This whole incident started when she told him to clean up his language or leave the restaurant.
He was cursing at everyone in sight, including some families with children. He kept saying he was going to get her, and a couple of nights later some coworkers saw her being dragged into a van, and intervened, but she ended up severely beaten and with a broken arm, where the guy had dragged her and slammed her arm in the van door.
Your boss sounds like a real loser, more concerned about the bottom line rather than the assault of one of his employees. You should consider looking for another job where you will be appreciated as a person.
I hope that the jerk that spit on you did not have any contagious diseases, that could be a problem for you also.
The only thing that you could have done differently would to have picked up the phone and called the police as soon as the bad language started, that is a verbal assault and you could have had him thrown out and banned from the place of business. If the business has a panic button to alert the police you could have used that, although I doubt if your boss would be forward thinking enough to have one installed.
Your boss should be thankful that you stayed on the job after this whole mess, you would have been justified to walk out.
I hope that the police will work on this for you, if this guy thinks he can go around spitting on people, who knows what he will do next.

In my opinion some people are not customers. I would never take crap like that from anyone. If a customer spits on me I interpret that as him wanting an a** beating.
You might be able to file charges of assault or something? If the police don't do anything you can still make it a civil matter since he used bodily fluids.
Either way, forget what your boss said about "turning customers away". In fact, I strongly encourage you to make your employers workers comp insurance pay for testing done to you since the jerk who spit on you used bodily fluid as a weapon. Do not let your boss tell you that it would not be covered. Don't waste time, and if your boss hassles you, contact your states Workers Comp department.

OK, I shouldn't say this but it appears you could have some fun with it. You are right that in most states getting spit on is a crime. It is in Texas and Washington where I have worked. Being that saliva can transfer various diseases, you may desire to inform you boss that you feel the need to be checked out by an infectious disease doctor at the company costs due to this assault. You now fear for your safety and health. It would fall under workers comp so he can't deny you. Make him jump through hoops about reporting the assault to OSHA and get checked out by a doctor and ensure they perfom tests for HIV, Hepatitis A, B. and C, and make them provide immunizations for them. You may need some time off work to accomodate these appointments and this should also be covered under workmans comp. Also, check out the current laws in your state to ensure they include the transfer of saliva under the assault statute and then follow up with your boss and the police for the charges. Good luck!!

spitting on someone is not just assualt it is a form of battery (a more serious charge) you need to press charges this is the most rude form of disrespect anyone can do.
I was a sheriff's deputy and I took being punched and kicked as part of the job but if someone spit on me I resorted to the justus approach.
It was just us behind some building.
By the way if you find out this guy has some contagious virus or something like that and he knew it prior to spitting on you the charge goes up to a felony as henious battery very serios charge. I had a guy with hep C spit on me and he got 8 years becuase he knew it beforehand.
If the police wont persue the charge then you can go to the states attorney and ask them to file charges.

It is an assault. The patrol officer can do nothing but file a report, possibly write a citation for it if he can locate the man. In CA, I cannot arrest someone for a misdemeanor crime not committed in my presence (with the exception of domestic violence and DUI).
The detective working the case will locate the man and a DA will file charges if the evidence is strong enough.

I don't know what state that you're in, but in some spitting on someone is an assault crime. I would follow-up on filing charges because you do not know if this person has AIDS. And let's say that he doesn't, but to show him a lesson, request (demand & don't take no for an answer)that he take an AIDS test. If you are a minor, please get your parents to assist you. Go on line and get as much information as you can about your city & state laws, that way you'll be more confident when presenting your case. Also, do not yell & become irate , remain calm & they'll take you more seriously

you should have asked the cop what would have happened to the customer if he spit on him ? He would have went to jail . I think that you need to quit that job cause your boss is an F----ing jerk !!!I dont blame you I would not have served him either. good for you . I probably would have kicked the dog sh-- out of him and laid him out and left him for the cops. Oh well you did right regardless of what the cops said . I would contact the supervisor at your local precinct and tell them that you would like for them to know that the cops in your case were committing dereliction of duty . good luck .

Gurl....I would have did the un goddly thing and slapped the piss out of him....But there is a better goddlyer way to solve this situation all u need to do is suggest to your boss that he should not be allowed 2 come in anymore...If it works and he comes back, then tell him off...and if it gets out hand then have security escourt him out....And if he spit in yo face again hit him wit anything you can get your hands on... :-)

You did all you could do in the situation. The police, and your boss did not help you. Now you must move on, right or wrong. Continue to do your job, or find one that has more pleasant customers.
