I gotta disagree with Penny a little on her answer...

Just because a debt is listed on your bankruptcy does not mean you are confirming you owe the debt. You are listing them as a creditor in order to include them on your bankruptcy. The debt can still be disputed. I am currently involved in helping someone with an identical issue, and it's probably going to end up in court.

To answer this question, just because the debt was not included on your report prior to bankruptcy does not prevent them from reporting it. The automatic "stay" placed by the court prevents them from attempting to collect the debt from you, but does not include reporting. However, they are requried to list this as "included in bankruptcy" and it must show a zero balance. Anything else is a violation.

This report will remain on your report for 7 years, but be sure they are reporting the delinquency date correct. It begins on the date of the delinquency. Many times they will report the filing date for your bankruptcy. By making them report the correct date, it can come off your reports much sooner.

With the bankruptcy they might not be able to collect from you but yes the can report it, yes it will remain on there for 7 years, the bankruptcy 10 years. You cannot work them out because you cannot dispute them, you already called them accurate in the bankruptcy. Most like filled, or listed before the bankruptcy which was the cause of the bankruptcy.

Call the creditors reporting the innacuracy first, followed by a certified letter detailing as much as you can, including copies of your BK papers and any proof that the debt was included in the BK or paid prior.

follow that by ordering a credit report from equifax.com, transunion.com and experian.com and follow the directions they provide to dispute anything incorrect on your credit.

Follow the above every month for 12 months. Your persistance will win.

What would it change? You've already BK'ed.
