This article http://www.nascar.com/2007/news/headlines/cup/09/30/kansas.post.race.ap.ap/index.html says " the field was frozen and passing is not allowed under caution". I understand them passing Biffle. But Jimmie Johnson clearly passed Clint Bowyer under caution. He gained speed and was clearly going faster than the rest of the pack. Here is the video http://www.nascar.com/video/cup/2007/09/30/cup.kan.final.nascar/frameset.exclude.html?MostPopular of him making the pass.

Should this be or is this a penalty?

My point of view is this. If Jimmie was right and they were suppose to at least make it back to the finish line then he would have been guilty of passing under caution.

Now if the race was over at the time of the caution the Jimmie was not guilty of a violation an therefore has nothing to complain about. He finished 3rd.

Penalty or not?

Actually "jgrevinj..." if you look at the video Bowyer had to speed up to get it back. They were clearly going way faster than the rest of the track. So that looks like a violation because Jimmie clearly passed Bowyer. Look at it close.

Actually, Johnson gave the position back to Bowyer before they crossed the finish line, so, no he didn't break that rule.
NASCAR made the ruling that gave Biffle the victory based on the fact that he made it across the finish line unaided, which is really all the rules require, according to NASCAR VP, Jim Hunter. If NASCAR had ruled that Biffle did not have enough momentum of his own to safely cross the finish line, it would have opened a paradoxical situation in which Casey Mears, in fifth place, would have been the winner, since Mears was the first driver to cross the finish line without passing the leader. Instead, they took the more reasonable (NASCAR officials reasonable? That's a new one.) approach of scoring the race as it stood at the moment the field was frozen. That avoided a very complicated set of results that would never be completely explained.

Not necessarily. The new rules put in that included the "lucky dog" freezes the field. Johnson was going to get 3rd even though he passed Biffle and Bowyer. Biffle still won the race. All he had to do was to cross the finish line. He accomplished nothing by passing the top 2 cars.

The topic to be argued for the rest of the season.
No passing under caution,so in that case yes johnson did violate the rules. But due to the caution the field is frozen so he could not gain a position.
Look for several teams to question NASCAR about the finish of the race.

Jimmie didn't pass Bowyer, He sped up so Boyer could drop down to get around the #38, but then slowed to give the position back... watch the clip... it shows Jimmie speeding up so Boyer could drop down to get around that SLOW #38 car....

Jimmie didn't pass him and "keep" the position which is the Nascar rule, you can't pass under caution and keep the position and the video clearly shows what Jimmie was doing if he was passing for position he wouldn't have slowed to give it back. Some of you should watch the coverage more closely.

No Boyer should be penalized for passing Johnson.
When Boyer didn't maintain the speed of the pace car he was in violation of the rule or out of gas so JJ went around him. When Boyer went around JJ he passed under the caution. Plain and simple. They surly didn't think that everyone was going to stop behind Biffle did they??
Wish I could agree because I don't care for Johnson but that is the way I seen it.

I agree with single mom. He clearly was just getting around the slow car and in the process allowing Boyer to also.

Should they have stopped? Come on.

I agree, Tina. They should at least adjust the final results of the race if they aren't going to levy a penalty. But we all know that will never happen!
