I believe it is 13 or 14, depending on the state. However, if the child can be proven to make the decision on their own without being persuaded then you can obtain an attorney and seek legal custody. Or if you as the father can prove you can provide a better home environment then you could gain custody. In the state you live in, if the child is of age by law to make such a decision and money is an issue then in most cases the child can obtain their own legal representation through the state and address the court in their own behalf. I believe it varies from state to state, but usually around 12 - 14. Usually the court will start taking their opinions into consideration in deciding custody at that time. It may even be 10 in some places. You should call the court and ask!!

I alot of states it depend on the judge really! they can be 14 or 12 if the judge can talk to them he will ask them questions and go thru a process.
