No, both legally and morally, you can not have the dog back after 3 years.

Who paid for the dogs care these past 3 years, was it you or her?
If it was your friend then I don't think you have a leg to stand on, legally.
If it was you, then legally I'd say the dog is yours.

As for the others saying that you should just let it go because taking the dog away from it's home will upset it - I don't agree, if you want your dog, will love and care for it and have the financial wherewithal to take care of it, and know that you can take just as good or even better care of it than your friend I don't see the problem. It'll take a few weeks for the dog to re-adjust and there could be some abandonment issues if the dog wasn't socialized properly, but with a lot of TLC and discipline things should be fine.
However, if the dog has a better life with your friend that it will have with you then I'd leave it with her (assuming that she wants to keep it).

Its a difficult one but i think you have to consider the dogs feelings here. If he is happy and settled and was only a puppy when he went to live with your friend I think it would be better to leave him where he is. If you had an agreement that you would have him back even many years later you may stand a chance... But im not sure which way a court would go if he is settled. Sorry... will your friend not consider you spending more time with him?

You might ask the friend in a casual way. Ask something like do you still want to keep Fido? I have friends who "kept a dog for a month or so" and still have the dog after 2 years, and they would be thrilled to give it back. It is a small yappy dog, and they much prefer big dogs.

I think, if you are now back to full health, it would be much fairer to all concerned if you go and get yourself a 'new' dog. Three years on, your puppy is no longer your puppy, it is someone elses best freind. Why rip that apart? Thank your kind freind for stepping in when you really needed the help, and ask for their help in training and socialising your NEW puppy....and you should all become one nice little pack.

you will not stand a chance of having your dog back if you have a signed agreed contract might help a bit but doubt.in law a dog is classed as goods you would have to go to the small claims court if the dog is happy let him stay it would not be fair to uproot the dog now .the courts will not look in your favour it will be your friend word against yours have enclosed a link if you are from uk of solicitor that deals wih dog ownership disputes..also somw useful information

You should probably get another dog. If the puppy is attached to your friend, it would be traumatizing for the puppy to be taken away. Adopt a new dog and save a life!

I think you should get another dog...the dog is probably attached to your friend already...You need a companion after your ill to bring up your spirits...Just go to the local shelter and adopt a companion..It might be hard to do.. I really would want the dog back but he might be emotionally distressed. Its really your decision

Your dog and your friend will have bonded too much to separate them now. It would be wrong to part them. Why dont you get yourself another puppy and then you'll be able to to walk your dogs together?

Your friend and the dog have bonded now. The dog is loyal to her/him. If you love him, the best thing for him is to leave him where he is. I am happy that your health has improved. Get a new puppy, maybe one from the pound.
