I just went through the K-3 visa process with my Vietnamese wife. I know for a fact that your cousin cannot apply for a K-3 visa for his wife if he is not a U.S. citizen. Knocking up his girlfriend is pretty stupid, but it has no bearing on his wife's ability to be approved for a K-3 visa IF he was U.S. citizen and able to apply for it.

Technically, your cousin might qualify for temporary or permanent residence because he will be the father of an American citizen, but this doesn't help his wife much. Add to all this that his girlfriend is going to sue him for child support makes for an interesting soap opera.

In my opinion, your cousin has certainly made a mess out of his life. He should save his wife the grief and leave her in Vietnam. U.S. citizenship is not worth living the rest of her life in chaos.

Im pretty sure he will be denied because if i remember right, only a US citizen can file for a visa. And if he doesnt have his green card im sure they will deport him too. Probably wouldnt be a bad idea as a guy that is married and has a pregnant gf sounds like not the greatest guy in the world.

Decide on the right choice because giving in to different situations will be a lot of headache. Choose only one girlfriend.

he is already married to a woman in Vietnam,
his personal life has nothing to do with immigration and USCIS,
if he wants his wife by him, tell him to file.
tell him to go to this page :
