I have happily had my son's custody returned to me. on aug 31, 07 my son father moved to florida from calif. my son who is 17 and still in high school wanted to move back in with me to finish high school. I ask his father to put something in writing that would explain that now i have physical custody. in reality his father will not be seeing him until he graduates high school. my son his in 11th grade. his father has stated that he wishes to retain joint physical custody. (in order to have reduced child support obligations?) since my son is going to be living with me 100% of the time, what would be in the best interest of my son? i have always paid my child support in a timely matter and have been always current. help i need some guidence, thank you.

if the father is 3000 miles away, does the court know he moved? he has to keep them informed of his mailing address and whereabouts...

since your son is a junior in high school, you really don't have long before child support stops... if it were me, i wouldn't even worry about it anymore... but do what you have to do.

consult an attorney or paralegal who practices family law. that's your best bet for sound legal advice.

I don't understand, you paid him support while the son lived with him? Now does he still want you to pay him? Why wasn't this settled when you retained custody? You need to take it back in front of the Judge.

Simply put --- This is a Court matter. In child custody cases the Court is always the arbiter and decides "What is in the best interest of the child".
