If you collect sales tax and don't surrender it to the state, you can be found guilty of tax fraud, and can go to prison.

From the way you word your question, you sound like you think you'd get to keep it.

If you are selling on ebay regularly as a business, then if you sell to a resident of your own state, and your state has a sales tax, then you are most likely REQURED to collect sales tax, and would then remit it to the state. If you are just selling a few of your own belongings, then you wouldn't collect and remit sales tax
