the car is financed how does that work if I cant get my cr back. I didnt know the dam boy had weed on him. Is it easy to get my car back, and what will the finance company do?

Oh wow, I'll tell you the hard facts when it comes to drugs our government switches fast from freedom to communism. What I can say is you should be thankful he wasn't found with drugs in your house!
There is some new law any property drugs are found on gets confiscated this does include people's homes and cars.
I don't know if you can get your car back, but you might be in a world of trouble yet. I feel sorry for you, you were caught up in something innocently, it is crap I know it harmed no one except you. This doesn't look good as far as I can tell, you may need a lawyer.
Have you ever seen those ads buy drug confiscated cars cheap?
Get a lawyer that is the best advice I can give you.

You still owe the debt to the finance company. Even if your car was totalled or taken away from you, the finance company can get you to pay what you owe. It may be more complex for them, but that's their problem.

If you had big bucks, there's no question you could get an attorney to resolve this for you efficiently. However, in the good old USA, if you don't have much money, you don't see much justice. This also applies to health, security/safety, legal affairs, and education. Inequity is on the increase.

We are working our way toward a large number of green zones and a red zones (like Bagdad), where the green zone is surrounded by a five foot thick wall and the living and amenities are great inside. If you live in the red zone, look out for arbitrary raids and unfair imprisonment and torture. If you don't live in a gated community, you may just be out of luck. The reality is law enforcement pays careful attention to your economic status and discriminates.

Why isn't anyone paying more attention to this bizarre state of affairs?

That is extreme for any Police to seize your vehicle unless they suspect it being used to deliver drugs or trafficking.

I have seen guys get arrested for posession of Cocaine that erupted from a speeding ticket. Their car got towed, they make bond, pay the towing fee and salvage yard fee and get their car out.

If your vehicle was seized and is being held as evidence then it has to be more than just a marijuana charge from the passenger.
I would get an attorney and you probably can get it back.

There was a case in Alabama where a car was stolen and used to transport drugs. When the car was found the guys were arrested and they seized the vehicle because of drugs.

The owner had to fight hard to get them to release the car back to them because it was stolen; However, they suspected that her son who owned the vehicle was involved in the drugs. Once the investiagtion proved that her son was not involved and it was a pure case of misunderstanding and the vehicle was ligitimately stolen it was returned.

Then came the hard part after three weeks in storage she ended up with a heracious bill from storage costs and wrecker fees. There is no easy way out, but in the end it will cost you one way or the other.

In your case when a passenger has drugs on them...yes you can be charged as well, but can beat that in court with an attorney and confession from the passeneger that you had no idea he or she was carrying drugs.

If the car was pulled over after you picked him or her up and then popped ...it's suspected buying or selling of drugs and that is probable cause to seize the vehicle. The difference bewteen seize a vehicle or impound a vehicle are based on two things.

1. Impound...you're arrested along with the passenger. Make bond get out and go get your car after you pay the fees.

2. Car or truck seized and held by the State for suspected trafficking of drugs. This time you can;t get the car out because it is evidence in their case and then you lose your car once the case is over or by the time they figure it all out you have accumulated so much storage fees it may not be worth to get it out if the value of the car or truck is ;ess than what is owed.

In any event you want to get your car out as soon as possible.

The question here is why did the Police or Undercover suspect your passenger had drugs to stop you to begin with?

Was you stopped on the road?

I don't have all the facts in your case, but like an attorney all the facts have to be disclosed before you can get an accurate amswer that would help you with your case.

As for the loan company, you're responsible for the loan until it's paid off in full.

The rules for getting your car back will vary by state law and circumstances. Some state do seize personal property, including homes and vehicles when drugs are involved, so you will have to check with the police to see what you need to do to get your car back, or if it's even possible to get it back.

The finance company just wants you to continue to pay until the loan has been satisfied. I'm sure the contract you signed with them you promised to keep the car safe and available. So in the event you can't get the car back, you obviously don't have it to return to them, so they will want you to pay.

Sorry for your problems, pick your friends carefully. But do check to see what you need to get it back. If you are allowed to get it, it will be expensive since you will have to pay for the tow and the storage before you get it out.

You simply pay the county impound fee. The finance company has nothing to do with it unless you default on the loan. In that case they will still attempt to collect from you. Feel lucky, usually the driver is charged since in all cases the driver is responsible for anything & everything that involves the car whether he "knows" or not. Be careful who you allow in your car next time, if they had ditched the weed in to the car or thrown it out the window it would have definetly fallen on you.

As long as you keep making the payments then the finance company couldn't care less.

But I would suggest talking to the police to find out what they say about getting your car back. And if any charges are being leveled against you then you really need to get a lawyer. Drug charges are not like parking tickets.

Know who you are hanging out with. Yes, you may lose your car. Yes, if you lose your car, you will have to continue the payments. The finance company doesn't care if it's been seized, you are the one that signed the loan and remain responsible.

It's probably in the impound yard, and you need to find out which to "bail" it out. Usually, that's the case. But, since it is financed, it might have been reposessed by the financial company and has ruined your credit. Call both your local police (but not 911!) and whoever sold the car to figure it all out. And choose better friends so you don't get f^cked by them

You need to find out where your car is? Sinc e the cops took it, it's in the pound. That's about $80.00 and up per day and you'll have to pay whatever the amount is to get it out. So, the sooner the better.If you can't pay it, then the car becomes theirs.(pound) They can sell it or whatever they want . ( This happen to my neice. She was trying to get the money to get it out and everyday it kept going up and up so, by the time she got the original amount that was due, it was 3 times that amount . They sold it )
