okay found out i was 4 weeks pregnant my hcg level was 138,i had pains in my lower left ovary area and i went to the ER and i was considered a threatened miscarriage but the doctor said it was normal for me to bleed and pains from uterus stretching,i was sent next day for hcg level again and it was 166,then two days later another gch count was 104,i started to bleed and have sharper pains that was coming like every minute,then 48 hours later my hcg level was 98 then three days later it was 95,then 1 week later it was 4, and i never not once was gave an ultrasound?so can i sue for malpractice because the ob/gyn said i was miscarring but i never got the proof?

to the dumb answer why is everything lead to sueing try because,i have been in phsyical and emtional pain for the past 8 weeks because the ob/gyn never proved to me i was miscarring,DO YOU KNOW WHAT IT IS LIKE TO WONDER IF YOUR BABY DIED OR NOT?????????

if they would have gave me an ultrasound then i could have seen that i was still pregnant or if i miscarried or if it was a tubal pregnancy,wouldnt you want to sue if your child was in the hospital for 8 weeks and the doctor said he passed away and you had no proof????

I know exactly what you are going through. I ended up have emergency surgery because I almost died from bleeding so much. I was 8 weeks pregnant and I started bleeding. I went to the ER and they did some blood work, did a pelvic and sent me home. They scheduled me for an ultrasound. I am an x-ray tech and I knew the tech that did the exam. You definitely didn't want to have to go through that. She searched and searched for a heartbeat and couldn't find one. I could see the sac and was even more devastated than I was before the test. It was like watching my baby die. The next evening I went again to the ER and they sent me home again. The next time I came back, I was in an ambulance with a blood pressure of 40/20 (normal is 120/80). i was rushed to surgery and I haven't been the same since. I have cried and wondered what that baby would have been and looked like and I still wonder to this day but there has to be a point when you are able to move ahead. I took antidepressants, don't be ashamed to ask for help.

There was nothing your doctor could've done to keep this from happening. I am sorry for your loss. I understand what you are going through. Here is a scary piece of information: it is more likely for a miscarriage to occur than for a healthy normal pregnancy to occur. Ask around, there are a lot of us out there who have been through this. When you are able, talk about it without the anger, you will start to heal although you will never fully heal. The way they prove you are miscarrying is doing the lab work. If it continues to rise over several weeks then it would've been fine but it dropped and they were watching to make sure it went down to a normal level.

In order to sue..you have to show that you were hurt physically or emotionally by the Dr's neglect.

The ultrasound results would have not changed the outcome...You would have still miscarried...

Also the HCG levels need to be around 1000 for anything to show up on the ultrasound..

I think you would have a slim chance at winning a lawsuit.....Plus the whole process could take years and end up costing you thousands if you lose..

I lost twins @ six months into the pregnancy to a condition that could have been prevented (or at least I could have made a decision) by an early ultrasound - I had NO ultrasound. I tried to sue the OB and I was told there was no case. All the doctors stand up for one another and it is close to impossible to get another doctor to confirm that yours did something wrong. You can try and see id a firm will look at your case (you need ALL your records) for free and try to do this but, they protect each other and they pay alot of $$ to have the insurance that fights for them. Try to heal and look for a support group/book/counseler to help you heal. good luck and God Bless.

Kind of anxious to sue, aren't you? Let me tell you something: At 4 weeks gestation, if there is a fault in the implantation of the embryo nothing; no amount of intervention is going to stop you for miscarrying. What in the world good would an ultrasound have done? Nothing. Sounds like they were checking to be sure you were physically sound. Leave it alone.

Edit: No, you could have seen nothing on an ultrasound at 4 weeks gestation. And, yes, there are probably some of these people answering, myself included, who have lost a child, whether through miscarriage or death. It is obvious you are hurting, but trying to make somebody pay for your suffering is not going to change anything. Sometimes there is just no one to blame. Medically speaking, I think they did everything they could for you.

No, you can't sue for malpractice.

No ultrasound could detect the implanted egg at about 4 weeks.

Your HCG levels were dropping indicating a non-viable pregnancy. Your proof of the miscarry was the 4 mIU/mL HCG level. At that point, there is no pregnancy.

This will sometimes happen.....we used to call it a "blot ovum"; one where the egg develops the beginnings of choronic tissue (which is what causes the HCG levels to rise), however no fetus actually forms. At some point, the choronic tissue dissolves and is expelled with the next menses.

166 is low for 6 weeks, they wouldnt have been able to see anything on an ultrasound anyways

the doctor could probably tell by your blood work that you were miscarrying, specially with the drop.

You can try, but you probably wouldn't win. Dr's are highly protected against malpractice.
