From my previous question, I noticed that TyranusXX posted that the NCLB was a violation of the Constitution. I have never heard that before. Can someone please explain to me why NCLB can and/is a violation of the constitution? Sources please!!!!

Probably because education is not listed as a power of the federal government. Traditionally it is a state government issue. The modern federal government has gotten around this, by tying education bills to other powers, so say, if a state doesn't want to follow NCLB, the federal government will withhold highway funds (or something similar).

NCLB is an attempt of the Federal Government to regulate education, a power not described in the Constitution, and therefore under the jurisdiction of the States or "the people," not the Federal Government, according to the Tenth Amendment.
