Our car was taken to a shop for a routine check up, and they said something was wrong with the transmission. They messed around with it and made everything worse than charged $3000 dollars. We then took the car to the dealer where they said the other car shop had messed up everything which voided the warranty, and its going to cost us another $4000 to fix it. Can we file a lawsuit against the first car shop who messed everything up? and if yes, how would we go about doing this? I appreciate your help!

Yes, They charged you to diagnose the problem. any resulting problems from the diagnosing or repair of the original problem is then responsibility of the shop. Most states, you file in small claims court or civil court. Your suit will be less than $5000. Go to the court clerks office and file a patition there.

Remember, A shop is reponsible for your car and the proper diagnosing and repair of it once you sign or autherize the work order.

You would have had to authorize repairs at the first shop. If they did something you did not authorize, they are definitely in the wrong for what was done. I would suggest you make copies of everything related to the incidents and go to a good lawyer. I would also suggest you contact the state attorney general and get them in on the action. They have a lot of clout.

What did you write at the Bill Of Sale. You do have a replica of a signed and dated Bill of Sale do not you? One along with your signature and the patrons signature. If you could have a Bill Of Sale it will have to state evidently at the file that the auto is being offered as-is and not using a guarantee or assurance and the vendor assumes no accountability for any upkeep to the auto as soon as this file is signed and the name is legally transfered.

It is entirely possible to sue the savages for the damage they caused. Seems like an easy win, too.
Hopefully, they aren't named "midnight auto" and can dissappear overnight without paying the court-ordered payment. You should be ok if it is a chain-store, though.
For about $25-$35....you can consult with a lawyer to see what is possible.

the orginal shop needs to correctly fix the problem or refund your money.
