On 03-01-07 I paid $700.00 first month rent and moved in. The water presure was low and the water was brown when I moved in. He said that it would clear up after I run it for awhile. It never cleared up. He never came to fix problem so on 04-01-07 I asked to be compensated because I had been washing dishes, and doing everything from my tub that required water. He gave me $200.00 off so for april I paid $500.00 and he said he would fix the problem. Plumber came out end of april and fixed the kitchen only. I asked for copensation . he said no compensation because the problem is fixed. I told him the problem is not fixed and showed him that I still have coffee coming out of the bathroom sink. I never paid rent again for the next 6 months he has not taken me to court yet. I want to go because he has not done anything in this apartment. Had place inspected by city who gave him 30 days to fix problem and list of other violations and he has not done anything. What to do?

You can move out and no it's not breaking your lease. He broke it by not giving you a proper place to live.

First of all move. I think then I would counter sue him for not doing the repairs and not correcting the violations that are listed. This move has put a hardship on you and cost you time and money that could have been avoided. I hope you put the rent money in an escrow account. If you didn't you will probably lose. But I would at least ask an attorney.

No you would not be breaking your lease because he has not done the repairs so this voids the lease.
He has not taken you to court because he did not correct the problems that the city cited him for. I would just move and not worry about it.

You already broke your lease by NOT paying rent. In the event you DO go to court, you had better be prepared to show that you have been putting the rent money into a bank account on time for those months. Housing court is not as cut and dried as people seem to think. In almost all states you have to go thru a mediation first. ONLY the worst cases go before the judge. If you lose or draw (as it were) you have to pay for at least your OWN legal costs, and perhaps his.
Your best best in any case is to take the money you put aside and move out. In not having to pay rent for six months you should have a tidy sum set aside. Unless (and I say this only because I know people who use anything to not pay the landlord) you were simply looking for a reason not to pay you will be better off. If you WERE just looking for rent free space, you deserve what you get.

PS-just as a note...most states do not allow the landlord to have the renter pay for water

I would get out of that place. It is unhealthy for you and your family.
The landlord is a slum lord.
Geturdon and Paul h have good ideas. I might add the following.
When you move to another house you will know better than to believe that the land lord will fix anything.
Inspect the place. Check out the plumbing electrical, doors, windows, and heating system. Make sure everything is in working order.

If you're not paying the water bill, run the water for however long it takes to come out clear---could take a day or so....probably pipes real rusty. Or move on to a better unit....sounds like a bad landlord anyway. Document every thing you can and get witnesses/pictures to the water problem and any other complaints in case he takes you to small claims for the back rent.

Sooner or later he will take you to court, so be smart ! take pictures of the water and write a letter to whom ever is in charge at the health department. and move out !

You might need to contact a lawyer because 6 months of unpaid rent is $42.000 and to pay this all at once plus penalties ,this might put you in a bad spot for a while.
So before you move contact the lawyer and bring the pictures with you as proof.

if you do move you would be in violation of your lease. on the other hand he is required as a landlord to keep these things up. if the city has given him notice to fix them then that's probably why he has not taken you to court. Now, look in the government pages of your phone book and try to find the renters board and give them a call. keep all receipts of everything. also, if anything is damaged due to this problem as well.

He may not pursue this because he knows he is wrong. Get away from this unhealthy place. This could become a condemned building. Move. Consider this lack of maintenance to be constructive eviction. If need be retain an attorney.

Is he paying for water? If yes, let the water run until it clears! If it doesn't clear make sure you have money saved to move elsewhere. When you go to court, make sure you bring good evidence on bad conditions!
