Me & my husband just recently signed a year lease for a rental house, heres the thing, we have until this Monday The 1st, to be out of our current place, so that gives us all weekend to move, although the new landlord is extremly particular about the paint, the tile grout, light fixtures etc. She just WILL NOT LEAVE! We only have this weekend to move in, because both of us requested off for the move. If we can't move in this weekend, then we are screwed, and she will not even try to help out, ( like moving faster with the repairs ) Is it completely binding if we just signed it yesterday. If need be, we have the option to stay where we are, & I think that's what it's coming down to. I just wanted to know if there was a law that states we have so many days to cancel, kinda like when you buy a car.

We were advised the new place would be ready by the 1st, & we could move in that weekend, thats why we scheduled everything for the 1st.

we have alreay packed everything, and we had an agreement with the new landlord to allow us to move in the weekend before the 1st, thats why we scheduled time off from work weeks ahead of time, all we had to do was move from one place to the other, although now she is claiming that we cant move in yet. We gave ourselves plenty of time, we requested the weekend off for this reason, & now she is backing out on her end. Which I know the lease isnt until the 1st Technically, although we DID have an agreement.

Boy, the first guy had a rude (and incorrect) answer!! The lease is binding both ways (landlord and tenant). The should state the move in date, and if you can't move in, then she violated the lease. If you have to be out of your place, I'd make her pay for a storage unit, and a hotel room. If she refuses then ask the landlord where you live if you can stay, or stay longer. If it were me, I'd cancel moving into the new place and tell her "go ahead, sue me". When it comes to landlord/tenant laws, the law is always on the tenants side. Any investor/landlord would have to agree. If she's going to be that rude and you don't even live there yet, imagine what your life will be like once you do live there!!

Whatever gives you the idea you get to cancel a car sale? No more than you can cancel a lease!

I have to ask, why did you schedule things to be out of your old place BEFORE the new one was ready? That was not very bright! You're just going to have to hustle it on Monday and take the hit for the hold-over, I'm afraid. Maybe next time you'll allow some moving time!

Addendum: Monday is the 1st. You cannot move in before then. Again, why didn't you allow time to move??

If your written lease says the 1st, that's it. Any verbal agreement to the contrary is meaningless. You should have had it in writing.

Its actually pretty simple.

What does your lease say. If you show up to move in on friday and you cant move in, they didnt hold up the lease. If you think this will happen just show up with a lamp and try and move in. If you cant move in, on that day, the lease is dead.
