I doubt that that name is Trademarked by whoever discovered / named the original artifact

Absolutely... under the following conditions.

Should McDonalds pet farm pay mcdonalds? no.. even though mcdonalds is a TM named.

You have to prove competition. I dont know rosetta stone but I have seen their software. For them to pay the estate for using that name they have to be in direct competition.

If the estate of Rosetta Stone is not in competition with the people that make the language software. What is the damage? There is no damage... ie no reason for lawsuit.

I can start a company called Airheart cookies. Amelia Airheart people would have to prove they lost money because of it. Meaning they have to be selling cookies too.

Im not an attorney but thats my understanding.
