My mother is handicap and there are no handicap spots near my condo. There are not even handicap spots anywhere in the neighborhood and the nearest regular parking spot is about 50 yds away. Those spots are usually full so the next option is street parking which is at least 200 yds away. My mom can not walk that far. She at times pulls up to our house to unload toys for the kids or to pick up something from us...she doesn't turn the car off, puts her emergency lights on and is on her way in under 5 min. Our home owner's association has fined us twice ($150 each time) for her doing this. We've asked them where else can she park and why can't she just briefly load or unload considering her condition? They won't respond and now they've fined us again except this time it was so I could load a huge exersaucer toy into her trunk for her to take home. I don't understand what the big deal is but is there any laws about disabled persons being allowed to load and unload in no parking zones?

Also, is there anything we can go to the HOA with showing it's ok for her to load and unload considering her condition? Are there any laws? What are her rights? Do we have to pay $150 every time she needs to drop something off at our house? It seems so ludicrous to me.

Is the spot she is stopping at on the city street, or on condo property? If it is on a city street, the condo association cannot assess fines. If it is on condo property, I would check state laws regarding the designation of a handicapped slot, or a loading zone, or both. How do people move in or out? Where do the movers stop, or are they expected to toss furniture in and out of moving vehicles?

It appears that the HOA is not sensitive to the needs of disabled persons and if you bring this up to the proper people at DMV and the American Disabilities Act people you may see some change in the future....

Technically, the HOA should acknowledge your mother's condition and rescind the fines. Try to find someone in the legal profession who can help you write up a draft, etc. explaining your situation, with a copy of your mom's medical condition and hopefully you won't have to go to court to solve this.

#1 I would sell out and move.. that would be waaaay to restrictive to me...

#2 I would talk to the city or county you live in about handicap parking to see if their laws overrule the homeowners association.
