I have a loan out with Citifinancial.

I asked them to change the payment date, they said they would have to get the approval from the head office. This request was put to them in July 2006.

Every month, I get letters telling me the payment is late and they apply a £10.00 late charge to the account, so far I have incurred £180.00 worth of charges.

I called them today, I told her that I asked for the date to be changed, she looked at the history and said that no one called me to tell me that they could not change the date, this was back in July 2006 so I have incurred charges because theyy could not inform me of what I asked.

Should I demand a refund?

I have a letter saying that they have changed the payment date to 31st of the month, they have it set on their system yo expect payment on the 9th of the month.

yes of course you should they should have informed you that your request was not allowed, but then again why wait 18 months to complain

You could but good luck getting it. We had a loan through Citi and changed the due date but it is a one time thing only and they do send out a letter saying that the date has been changed. More and more companies are using whatever grounds they can to nickel and dime you to death.

You don't have grounds to ask for a refund. Until you receive written notice from Citi that the payment date had changed and your contract with them is duly amended, you are still responsible for making payment in accordance with the original contract terms.

Make a copy of their letter and your payment history
showing you have been paying on time and if they
do not credit your account for the late charges you
will have no choice but to sue them back.

you can try but it won't work. If you never got confirmation that the due date had been changed, you were late on those payments. Sucks but that's how it is

NOT unless there is something in your contract saying you can change the date. Your asking is not enough -- they must agree in order to make a deal.

Suppose I ask you for money, and you ignore me -- do I have the right to call you a month later and ask where it is?
