I just got a housing voucher, been waiting like 5 years, and the rules are that we must sign a new one year lease where ever we move to. The thing is that I still have 5 months on my lease left where I'm living.

I just had my third baby boy two days ago, and our apartment is far too small for all of us. How do I get out of this lease so that we can move into a larger nicer place, without having to sign a whole new lease here.

These apartments have no yard to play in and no three bedroom units at all. I look forward to now moving into a larger place possibly a house.

You are on the hook for the remainder of the lease. However, if you move out early, the landlord has the duty to mitigate his damages, by trying to rent the place out as quickly as possible. If that happens, you are liable only for the time the unit was vacant. If your landlord is willing to work with you, you may be able to find a new tenant to move in when you move out.

Leases are contracts and once you sign you're bound by its terms just as the landlord is. If it was easy to "get out" of a lease, you'd be in danger of having your landlord throwing you out any time they thought they could rent it for a few dollars more. It cuts both ways.

Every place is different. My company offers a buy out program, but that is fairly new. What most leases state is that you will forfeit your deposit and will be responsible for the rest of the lease. They aren't allowed to charge you and someone else rent for the same place, but you are responsible until they re-rent it. Some places are nice enough to try and rent your apartment first, but some won't because they are getting income from it no matter what.

Section 8 may be able to go to bat for you if they have any pull with this landlord, but maybe not.

All that being said, this place has been good enough for you for as long as you have lived there, and the baby you just had isn't going to be using a yard in the next 5 months. Now that you have a voucher you can get a nicer place. I don't think it is fair that people like me work our butts off to provide for our families and live where we can afford and have people who can work but don't choose to, or have several children so they can't afford larger nicer places get help to live. I am a single mom and have worked 2 jobs to make ends meet so I don't use assistance. I think Sec 8 and the such should be used for people with disabilities, not lazy people.

Be prepared to lose your deposit and pay at least two months rent. It's also very possible the office will require you to pay rent until the unit has been rented again. It's going to cost you, but if you can afford it, then just pay. If not, just live there until the lease is up so you won't lose money. The baby doesn't have to be in a crib yet, it can be in a bassinette to save space.

Read the lease. Typically they will contain information on what has to be done to break the lease. More than likely you will have to pay some cash to get out of it.

well you knew 9 months ago this was going to happen

guess you have to wait unless you can arrange for someone else to sublet youre apartement or the landlord has someone else to move in already

explain to your landlord...most will let you out but they will keep your deposit...and you have to pay an extra months rent.
