The constitution states in the event of invasion a state can form a militia. If the southern states declared an invasion was occurring due to the mass numbers of illegal immigration and made plans to form a militia under the constitution provision, would the federal government speed up its efforts to solve the illegal immigration problem or would they react in a negative manner to the states? Minutemen are not a state raised militia and states have an equal right to protect the broders of state from invasion.

no. if a state tried to do this, the president would immediately federalize whatever militia the state had raised and order them to stand down. (the president can now, under the patriot act, federalize any state/local/municipal/county, etc. law enforcement agency/force). if they wouldn't stand down....then they would all be arrested for disobeying a direct order and subject to military law.

Supposedly the militia requirement is fulfilled by the state run national guard.
When AZ tried to deploy them for this matter the President decided that only he has the right to deploy the national guard and redeployed them.

Sorry man, Amendment X is gone as are all other protections for the states against the federal gov't. Lincoln started the process, Bush/Cheney is finishing it. If a state tried to get a separate militia today they would probably declare it an act of rebellion and put it down with military force.

States do have a right to form a militia. Probably not for long though. However, the reaction of the Feds would be to declare martial law on the state, and the militia would be shot on sight.

No because the Congress do not recognize the immigration as an invasion. They would probably move to stop the states from doing such a thing.

I believe what the constitution referrs to is an armed invasion although who can say that that's not what is taking place now. These illegals are just walking across our borders unchallenged, I doubt they're unarmed.

every state already has a militia, It is called the national guard They are operated by each state individually.
And NOTHING will ever get congress to act quickly!
