If you have filed a marriag license for record you must either divorce or annul; but there must be a legal action of record recording the end of the marriage; especially if you have children or ever plan on remarriying

You still need to get the divorce. There's a legal document saying you're married - so there needs to be another stating the marraige has ended.

Of course you still have to get a divorce - there's not a "trial" period in marriage where you can just walk away. Unless there's cause for an annullment (one of you mislead or lied to the other about something important - like one of you was gay or already married or something). But if you're just not getting along or no longer in love, you're still married until you divorce.

You are correct.. even if a marriage lasted a week u still have to get legally divorced.. once ur married ur married, the only thing i can think of that ur friend may be confused about is having your marriage annulled.. but even then it has to go through proper legal procedures..

No you have to get divorced even if it is less than a year. If you are only married a very small amount of time (like weeks) you can get the marriage voided but you have to go to court to do this.

Of course you can't just walk away and think that you're free and get married again.
You'd need a divorce first or you'd be a bigamyst if you were to remarry and could face prison!
Don't believe everything you hear. Better ask a solicitor if you're in any doubt.

There is a period just after the marriage which its can be annuled without a divorce etc, but i think its a few months only, someone will no in the church or civil legal system

What? Where do you live? Of course you have to get a divorce! If you just run off and never speak to each other again, you cannot get remarried....you're still married. It has to be legally ended somehow!

I am sorry if you are not Canadian but I believe this applies to the U.S.A. as well that if you have been legally married with a licence then you need a legal divorce.
If you do not get a legal divorce and decide to remarry then you can be charged with polygamy.
