Know I know that there are good Cops and bad Cops out there just like there is innocent and guilty people out there. So unless we know all the facts it looks like to me that the person that was aressted gave more of a cuase then just coughing at a police officer, i can be worng be that is a little over board and stupid! I think!!! Need more facts to conclude what really happen and why this happened!! I will stay tune for the info!! Cheers!

Tell you what, I will come over and cough in your face. How about it? Somehow I doubt that would be acceptable to you. So why should it be for the Officer? And coughing, spitting, spattering blood etc. on a person intentionally is a crime. Sorry but you won't get any sympathy from me on this issue.

There is definately more to the story.
Normal people are taught to cover their mouth when they cough. Not to look directly at an officer and expell spit three times. Not once, but three.
He can play stupid all he wants. This was an intentional, premeditated act, and he is just looking for a legal loophole to defend himself.
And I don't blame you for reacting like you did, I blame the media. Controversy sells, and they are masters at only giving the questionable facts of the story.

I don't know what state you're in Mr. KnowItAll but, in Texas, that behaviour could be interpreted as "disorderly conduct" under the Texas Penal Code. Especially if it was done purposefully on the part of the driver. I mean, after all, would you want someone to do that to you, and you were a representative of upholding public safety? I wouldn't!

in some cases,there are abusers of power - you'll have that. (the taze incident of late) but in most cases - there is more to the story. we have to understand what the officers go through,and crime and attitudes are out of control in this country. in the first place,if you are doing the right things,you should never wind up in a situation like that to begin with.

Before even reading the story in the link I pretty much figured out what happened. Deliberately coughing or sneezing on someone is almost like spitting on them. By the way spitting on someone is thought of as battery.
If this person turns out to have some sort of contagious disease like AIDS the charges can be even worse.

There are laws that prohibit the exchanging, or attempted exchanging, of body fluids from persons infected with diseases such as HIV. If I were guessing I'd say that the person charged had an infectious disease, or claimed to have one, then intentionally coughed on someone claiming to try and contaminate them with the disease.

Sounds like it could be simple assault if the cop could articulate that he could tell that the driver was intentionally aiming his phlegm spray at his face.
