Sure you can apply for unemployment, it's not your fault that your employer didn't report your taxes. If the Georgia dept of unemployment asks you about your taxes you should be able to show them your pay stubs or some proof that you did get paid a salary for the time that your employer didn't report taxes for you. Hopefully though you didn't get treated by your employer as being self-employed instead of an employee. If that's the case, then you can't apply for unemployment.

If you had taxes withheld and not reported, take your paycheck stubs when you apply for unemployment. Let the unemployment people deal with the employer. If you were being paid commissions or properly treated as an independent contracts, you are out of luck. Also keep track of unreported wages so that you can document them to Social Security otherwise you will lose out on proper credit to your account and cut your retirement benefits decades from now.

You didn't notice that no taxes were being taken out?

It sounds like he was illegally paying you under the table, and you were accepting money that way which is illegal for you also if you don't report the earnings and pay taxes on them.

If no unemployment was paid in by your employer on your behalf, then you wouldn't be eligible for unemployment.

since he didn't file, they won't have a record of you - you might be screwed. Are you an independent contractor or do you get a regular weekly/biweekly paycheck? If you are a contractor who gets a 1099 at the end of the year - you are not eligible for unemployment

I think so. I never have, but a friend of mine did. We're in VA by the way.

Good luck to you anyway. I hope you can get back on your feet quickly!
