if i dont do it the department will fall apart. All management tells me is "keep everything working well till he gets back"
what do i do?

If you are being told to keep the department going -then step up and do it. It's awful what happened to your boss - but this is a good chance for you to show them your leadership abilities and what you can do.

I had a boss go out on medical issues and I was the only canididate to step up to the position. I was asked to keep the promotions department running.

I then became the boss for 4 months until they hired a new permanent dept. head.

They did offer me the position then a say in who was hired. However, I hated the woman that they ended up bringing in, even though i stated that she and I would not work well together.

It's 3 years later and I don't work there any longer.

They should ask, not tell, you to step up. This puts in a great position to ask for more money at your next evaluation, or just get the promotion to this job after it's determined that he's not coming back.

You should contact upper management and offer your expertise in handling his affairs. this will show that you are a team leader. It may also help you in achieving a promotion in the future if you do a good job.

No, you do not have the legal authority to handle his business affairs in his absence. That is actually a criminal offense.
