My Ukranian Girlfriend came to the uk four years ago using a student visa. Her visa ran out a long time ago and since then she has been working for one of the many unscupulous employers in the uk happy to exploit her illegal status to make her work long hours for very low wages. We met late last year and are very in love. I do not want to be separated from her and I need advise on how she can legaly get a uk passport or visa without being deported back to the Ukraine?

According to Tony McNulty (head of UK Immigration), she can stay 14 years and apply for amnesty to remain - which might be considered if she can show she has a life, earns money, etc. http://www.homeoffice.gov.uk/passports-and-immigration/immigration/?view=Standard

But the Home Office says that to get any visa, she must first return to Ukraine and apply. Unfortunately, when she leaves, it will have already been noted that she overstayed her visa, which means even with marriage or a baby, she will be unlikely to recieve a visa to the UK.

But she can make application under Regularisation Period for Overstayers Regulations 2000. Section 395 is your best bet though.

Oh, and seek an attorney. You are harboring a fugitive.

If you can wait about another ten years until 2017 when Ukraine hopes to join the European Union, then it won't matter - she wouldn't need a visa at all!

In the meantime, as others have said, marriage or a baby are the safest bets, but in honesty, how many illegal immigrants have actually been sent back where they came from? Not many, I'll bet. Tell a good enough story to the immigration officials and who knows. As long as she has a job, makes an attempt to fit in and speak English and isn't sponging off the social services and benefit system I don't care how many foreigners want to call the UK home. Handled correctly, immigration can be a good thing for the economy.

Well as far as I know they don't get british passports, they may be able to claim asylum but I don't think they even have to do that anymore because if they get caught working illegally and they don't have any documentation the authorities are forced to release them, what kind of madness is that. So I think the lure to the UK is the ease in which they can obtain work illegally and basically do as they please. Its not so much the illegal immigrants we should be worried about although they do need to be deported once caught, its the people who employ them we should be really worried about, because if they flout this law regarding employing illegal foreign workers what else are they getting up to illegally. Lets face it once someone becomes accustomed to breaking the law for one thing it then becomes easier and easier and sometime a necessity to break the law for something else.

First Marry her, then move back to the Ukraine and apply for the proper permission for her to come and live with you in this country. It usually only takes about 2 years.

There is no way you can get her a uk passport or visa whilst she is here as an illegal, unless the government announce an amnesty for illegal immigrants.

Because she is illegal their is no chance now or in the future for her to get the proper Visa.She will be found and returned to Ukraine as to yourself you will be charged for harboring her.On the other hand your story may be rubbish and you are testing opinions as you both intend to commit thge crime.

If you love her that much, then move to the Ukraine with her.

Illegal immigrants are a big problem in this country, as are unscrupulous employers who pay slave rates to illegal immigrant workers.

People like you are just exacerbating the problem.

You'll get no sympathy from me.
