I have been sent a letter to appear in court as a witness but I don't want to and I'm not going to be here when it trail is due.
I have been trying to find information on the web for my rights as a witness but the only rights I found is for victim, witch I am not. Does anybody has some legal advise for me or have been in this position before

In this instance you don't have a RIGHT as much as you have a RESPONSIBILITY.
" I don't want to" doesn't apply.
Contact the prosecutor and see if you can make a deposition
regarding the incident.

You need to either show up or get permission in advance from the judge to delay your appearance. If you do not, you will be found in contempt of court and a warrant may be issued for your arrest.

If the letter is a summons you must go to court or you may be cited for contempt. If you are not going to be in town then you should notify the court.
If you have not received a summons you are not required to answer the letter.

You need to contact the official that signed the subpeona. They are the only one that can excuse you, or you may be found in contempt.

Talk to the District Attorney on the case.See if you can just give him a statement.Why don't you want to be there? Of its fear then Talk to the DA if it is something other than fear then you need to testify.If you don't then you are as guilty as the perp.
