Is it ok to shoot this squirrel there is this tree thats it likes to play in and it's on private land but it leans on to public land is it ok to shoot it when its in the tree as long as it is over the line?

I'm going to disagree with Doc on this one.

While the tree is on private property, anything hanging over the fence line is public property. If a road ran under the tree limb, the highway dept. would have all the legal authority they need to trim the branch back to the fence line. The limb overhangs public property.

So, you can shoot the squirrel. However, if you only wound it and it scurries back to the main tree (back to private property) and then dies. You can not retrieve it without trespassing. Be sure to blow it off the limb. . .

First lets assume that you have a hunting license and that it is squirrel season and that it is legal for you to be hunting on the public land. If you can answer yes to all of these, then, yes, it is legal to shoot the squirrel in question. However, if it falls on private land, you have no right to retrieve it. It must be abandoned. It may not seem right to waste an animal like that but it is your only option unless you have the land owner's permission to go onto his property to retrieve your squirrel.

NO, it is not OK.

The tree is on private property, that means the tree is private property, even if a branch overhangs public property. That means the tree rat is out of bounds as long as he is in that tree.

So don't shoot. One pesky tree rat is not worth sacrificing your hunting ethics. There are plenty more in the woods.

Is is ok there is to many squirrels around there.
