Can cops hand out gag orders to wittnesses of a crime ?
Do they have the authority to do that ?

Yes. And if you violate it you could be charged with obstruction of justice.

BTW, it would NOT be the cops handing out the gag order. It would be the DA's office.

No, only a Judge can hand out a "gag-order".

Cops can ASK that you not speak about a crime... the DA might push for "interference with an investigation" charges... but only the Judge can issue the order.

If the witness to a crime is doing or saying something to get in the way of prosecution, it's possible if they are interfering with the investigation or hindering prosecution as it's called in some states. Cops no, but judges yes.

Cops might suggest it, but only a judge can order it.
