Dear All, I got my H1-B approved visa from USCIS this summer and applied refund for Premium Process fee. The refund check was issued and sent to my lawyer 3 weeks ago. Even though my visa case was closed and I made the whole payment to my lawyer few months ago, my lawyer suddenly emailed me a expense statement 2 weeks ago and said that I have to make the rest payment in order to get the refund. Is there any way I can deal with this mean lawyer? Thank you very much for your sharing.

Why should the lawyer give you back that money when you still owe him/her money?

Sure. File a complaint with the Bar Association. Nothing gets a lawyer teed off and into action than a bar complaint at their door and an investigation.

In Texas, you can file a grievance or complaint with the state bar of texas. It costs you nothing to do this. Lawyers hate them!!

What ever state you live in, find out what the equivalent is and inform the attorney in writing you intend to proceed with this complaint or grievance if he doesn't cooperate with you. State exactly what you want and when you want it. Give a deadline for when you are going to send the complaint.

This may work. And it doesn't cost you.

Take him to small claims courts and report him to the Bar.
I only hope you have everything in writing, the first contract , all your payment information.

U know most lawyers will suck u dry, its gonna be a tough one

That's like expecting to receive rebate checks for retail purchases. The time spent maneuvering through all the red tape will put you in the red zone.

Call the states bar association and file a complaint.

You can sue, but that will require another lawyer. Also, I'm sure he knows the law, and probably wouldn't violate it.
