If a male exposes himself (even for a quick moment) to a female employee while they are the only two in the store (both are employees) how much money can the female get in lawsuits and how much trouble will the guy get into?

I am asking as a hypothetical question just because me and a friend are arguing that the female would get more from suing the store than suing the male who exposed himself.

unless the store condoned it or ignored previous compliants from the female employee of sexual harrasment (allowing a hostile workplace) the person would have no basis for a suit against the store.

They would have to show negligence of the store to win a suit against them.

the guy who did it of course she would have basis for a suit but it would be a he said she said suit. Unless she could identify something about the part he exposed that would prove he did it she wouldnt have much of a case without witnesses.

I work with a very tall, very attractive, young blond lady and she has a terrific set of legs and a good firm rack. She can flash me any time she wants!

But to answer your question, yes your friend is right. Companies have much deeper pockets than individual employees. So the store would get the butt end of the lawsuit.

Probably she would get nothing at all, presuming the two were peers, the "exposer" was not her supervisor, and this happened only one time. The guy could be arrested and he could be and should be fired. If the store takes prompt action upon her complaint, it is likely there would be no liability on the part of the employer.

How much some one can get in a law suit is a hotly debated question and not set in law. She could get anywhere from nothing to large sums of money from the store depending on the store's sexual harassment policies and how well they enforced the rules when the incident occurred.

You wouldn't get any money.

The 'big money' lawsuits don't come because a male exposes himself. It comes when a complaint is registered, and the company chooses not to act.

IF you report this, file a formal complaint with your company, and they choose to do nothing...then you MIGHT have a case. However, it's still just your word against his, and it's a fairly small (no pun intended) transgression. You haven't been discriminated against. Your wages are not affected. He didn't touch you.

In short, I wouldn't quit your job and move to Florida quite yet.

I would not want to be a male employee in the store where you two work. Looks to me like two gold-diggers looking for a way other than putting in a good 8 hour day of work to become rich.
Hypothetical today, reality tomorrow.

Sue the store. The store is probably a multi-billion dollar company while the guy is probably making about $15.00 an hour.

lol ya...i hate law..its very stupid..i love how the store can get sued for not doing anything wrong, and most likely trying their hardest to keep their employees happy while the guy just gets canned. i dunno how much money and all that sorry.

First off she would have to prove that it happened. Then if he backed up her story, they would both be look at with suspicion of conspiracy to commit fraud against the store. Tread lightly.
