he said that he was driving his car when he seen me but didnt stop me thre and then and that he wanted to meet me in town tomorow to issue the fixed penalty would he not need to issue the fine there and then please help this guys stalking me every day i see him he said i was driving to fast for him to stop me so how could he see me smoking a hand made ciggarette

as far as i know it's not against the law to smoke in your car, how did he get your phone number?

Its either a wind up or a stalker - if you want to avoid embarrassment then just dont turn up to meeting point, however you say you seen this guy so do you know him? If not then go to the police let them find out who he is - he certainly is not an environmental health officer (or at least not a legit one)as you can smoke in your car if you want to. Dont confront him - just hand it over to the police or call the envronmental health office yourself above all Be careful!!

I still dont think this can be genuine - why on earth would he arrange to meet you to give you a penalty notice - surely if you were in a works van then he should send penalty to your employer to pass on to you - you do not need to meet him - offer to meet him at the local police station and or his place of work and make sure you have someone else present and it is all recorded properly - there is definitely something not right here so again be careful!!

Your work van is only exempt from the smoking ban if it is solely for your use - if you ever have to transport other people for work, or other people drive it themselves, it is covered by the ban - in which case you could legitimately be stopped and fined. If you think you should be allowed to smoke in the van, you and your employer will need to prove it to the council, or whoever issues the ticket.

As to whether this person is genuine, you will need to contact their employer (your local council?) to check them out.

If you keep smoking in the van, you're a sitting duck - each time they see you smoking they get to issue another ticked whilst doing virtually no work - do you blame them?

Perhaps you should take the hint and try NOT smoking in the van, at least for a while - and let the lazy environmental officer do some actual work for their tickets!

I would advise the following
1.. Report the matter IMMEDIATELY to the Police ( how do you know he is who he says he is.?)

2..seek advice of a solicitor re the 'following' i.e. harrassment (stalking)

3.. Get solicitor to contact the local authority (enforcement department supervisor) to state that this person is 'following' you, which is infact surveillance, and demand to get copy of the written authority which would authorise the employee to carry out this course of action.. If no written authority, your solicitor will know what course to take .. seek court order , ordering this person to cease conduct / actions

The smoking ban is a statutory law that means that the police dish out the charges....not a local authority enviromental health officer

Deny smoking and ask to see his proof. If he cannot produce conclusive evidence then report the tw@t for harassment to the old bill.

If you want a *** (sorry, cigarette) - find a lay by and get out.

Tell him to stick his penalty notice where the sun don't shine. it's not genuine even in this 1984 society you can still smoke in your own car
