I found a roach in my salad at a major food chain in the south , I have five witnesses and the manager apologized repeatedly. Claimed the workers didnt rince off the sald properly before they ate it. Getting me sick all over again just thinking about it. Do i have a case or what ? What steps should I take?

first of all its was my wife and yes we had been eating for about 5 minutes she had eaten maybe 1/5 of it , she did get sick and had to throw up. She also had flu like symtoms for a couple of days. The manager new what was up and immediantely scolded the guys in the back like he already knew they had a roach problem.

you do have a case. do you feel the apology was sincere? that is such a disgusting thing to happen and they should compensate in some way. however, if you do take legal action the manager and many people there will be out of a job. if it's money you are seeking, you could definitely sue. just think to yourself if it's really messed up your life, because along with suing comes people judging you about being greedy and just think what would the guy up there would think. suing may be the right thing to do, just think about it! good luck

He probably DID already know about the roach problem. I agree with the folks who advised you to call the health department. That restaurant needs to be shut down until they take care of it and are in compliance. Just think of how many people might get sick because of roaches crawling around on their food and on the counters, etc... :(

Since the manager apologized repeatedly, I would say let it go. He probably told the workers off and whoever did the salad that day might have gotten fired!
Do not punish a company because its workers were at fault. If your complaint was ignored and they denied it and you have witnesses that's a different matter.
I would be merciful to them unless this happens again.
It is not good to sue. We live in a sue-happy society and that's not good.You and the witnesses may not go back to that place to eat again and that would be punishment enough too for that restaurant.

You should definetly call your local health department!!! I believe that they are listed by which county you live in. They can take care of that problem for you. Also, you should send an e-mail to the president of that restaurant, go can just go to their website. Good luck with that!!

Yes...You have a case. You need to call a law office first and get some legal advice then you need to call the health department. Good Luck!

The irony here is that the roach is probably more nutritious than the food. However you didn't request the roach so I suppose that you have a right to a free meal and nothing more.

Well other than thats totally gross you should go back to the resturant and tell the manager because thats poor service. But only if it hapens again because that to would be very gross again.
