You see I was married once before and I dont really want my baby to have My ex's last name and I would love to give the baby my maiden name but I never took back my maiden name after my divorce so can I do that?

You may need to consult a legal service and change your name back to your maiden name first. But I don't think that it should be a problem.

Your child does not have to have the fathers last name!! There is no law for that. So do not listen to the person who stated that, they are incorrect. They asked me when I had my daughter if I wanted my last name of the fathers (B/c we were not married yet)

But Why dont you go & get your maiden name back before you have the baby?? It does not take that long or cost anything. Then you can give him your maiden name with out any hassel!

Do you intend to take back your maiden name?

My understanding is that in the US, you can give your child any surname you like, but that it may cause confusion in hospital/insurance records. (I have friends who were in the middle of a similar situation and gave their children a surname neither of them currently used - a few months later all the paperwork went through and now they're all Smith.)

If you intend to reclaim your maiden name, why not do it now? My guess is that all it takes is showing your divorce decree. That way you'll have the name you want - and so will your baby.

You should be able to, haven't heard of anyone not being able to.. But you could also give the baby your maiden name as it's middle name if you want the baby to have it's dad's last name...

not really sure...depends on the state and its laws. i'm still legally married, and pregnant (he's not the father) and even though we have been separated for quite sometime, my husbands name goes down and the father and they pursue him for child support. now after the baby is born he can take a dna test to prove he is not the father and get removed from the birth certificate and then my child will get my maiden name if i choose. once the father gets out of jail and takes a dna test to prove he is the father, my child will get his last name which i think is a lot of name changing for the poor child.

I think that's a good idea, both in naming the baby and taking back your maiden name. If and when you marry, then he can adopt the child, if you wish.

yes it can have your maiden name.
babies do NOT have to take their fathers last name, in this day and age half of the mothers don't even know the fathers last name. my best friend was raped and the baby has her last name, not his. there is no law saying babies must take their fathers last name.

dont listen to anyone who says you have to give it your husbands name ''you dont '',you could give the baby any last name you choose ,your maiden name your mothers maiden name hell you can make one up if you feel like it ,,,i know cause i did that for my baby not make one up but gave it my last name

If you wanted to you could give the baby MY last name. You can name your baby anything you want.
