On 3-9-07 I had some septic tank work done for $1200. I had new field lines run and the whole works. We still have sewer coming up in the yard in three different places. I have contacted the company numerous time but still haven't got them to fix it. I have my receipt and also a one year warrant y on parts and labor on the receipt. What should be my next step?

Much depends on which state you live. Please understand there are different rules for each state. However, your amount is probably a small claim. Do you have a written contract or was it just an oral offer and acceptance. This is critical. If you had a writtnen contract, did it provide for attorney fees in the case of a problem. These are important. Actually for the money you are talking, it sounds like the price was too low for the work you describe. This may mean you are dealing with a substandard company. Go to your disctrict (smaller) court, not the superior court. There is a district type court in every county in every state. They will have information available on small claims processing. Read through that info. You might also go to the county seat law library. All counties have one. It may be at your court house. If this is an out of town trip, my sympathies, but you will need to go there, as most such information is not on line. At the law library, the librarian can help direct you to a book to read which will answer your initial questions. If you written contract provides for attorney fees, then consult with an attorney. You will have to pay up front for the attorneys time, but you will also get it paid back when you win. Probably first you will need to put the company on written notice of your complaint. Up to now, you may have dealt with them orally. That is the biggest problem of our society, we have become so oral. the law and relationships are only dealt with on a written basis, because that can be examine when there is a problem between two people. So write a letter, send it certified so they know what your beef is. By sending it certified receipt returned, you will have proof they got your letter.This will also set in concrete whether you have a warranty claim. Up to now it sounds like you have the warranty but no proof you have made a claim against it. So get cracking. Good luck

These companies are normally licensed. Check with your City or County offices. This is a health issue so you may be able to go through the health department.

advise them you are going to take legal action if they don't fix the problem. call around to some lawyers, small, one man firms are best for getting free advice. if there is one in your town, try the local legal aid. they'll at least tell you what your legal options are at no charge. small claims court may be the legal venue you have to use to get your problem fixed. good luck.

contact a lawyer.
sometime having a letter sent is all that is needed.
it is cheaper to fix then go to court.
