You have to search your gut and do what you believe is right. You should have copies of your paycheck stubs and you can determine yourself if you were overpaid or not. Right now, it is your word against theirs, and if their accounting is sloppy enough to overpay you, how accurate can it be now? Their accounting/payroll department must have been audited and some errors were found. A lot depends upon how much money is involved in the alleged overpayment. Can you pay it back and not miss it or will you starve and go homeless if you have to pay it back all at once. That is what you need an attorney for. Most will give you 1/2 hour free consultation.

Morally, yes, you should give it back.
Legally, it depends on the local laws. See about getting a free consultation from a lawyer if you're dead-set on keeping it.

You don't say how much it is. If it's substantial they could take you to court over it. Make sure it's worth the court costs before you keep it.

Did they overpay you? If so, you should do the ethical thing and return it. If they didn't overpay you, then you should write to them and explain that there was no error in your final paycheck.
