I was in a wreck yesterday and need to know what I should say in court. I was turning left and the light was green; there was a big SUV stopped. As I turned left (I went really slow to see if anything was in the lane next to him…and a car drilled me. The speed limit was 20 and they were easily going 40 – 45 mph. My car is totaled and we both walked away fine. I took pictures of the road to show her skid marks. She admitted she has been in several wrecks and on medication. Since I was the one that caused the wreck am I screwed?

When turning left, you are required to yield the right of way to oncoming traffic! If you turn into the path of traffic, the accident is your fault! If does not matter if the car that hit you was speeding. It does not matter if the driver was drunk, or on drugs. The only thing that matters is you failed to yield the right of way, turning into the path of oncoming traffic, and caused the wreck!

Your insurance, if you carry collision coverage, will pay the value of your car, less any deductible! Your liability insurance will pay for her damage! Your rates will most likely go up!

Call a lawyer that specializes in auto accidents ASAP. Try not to talk to any insurance companies before getting a lawyer and then let them do all the talking for you. Shouldn't cost you anything unless you win something in court at which point they take payment from what you are awarded. The last thing you want to do is go against the other party if they have a lawyer and you dont!

they will only look at the facts

if the other person was speeding , and your pics of the skid marks will prove that

then it might not be so bad for you

but you were in the wrong pulling out , so dont count on getting off scot free

always tell the truth in court , perjury is a lot worse than a traffic offence

Kasey had to pit for tires and finished the race 2 laps down, which ruined his day. As for replaying it, they did not have it on digital camera. They did a digital replay of the incident. Which confirmed Kasey getting dumped. It became into no racing twist of destiny in any respect!

OK, U R AT FAULT SO U SAY. SHE WAS ON MEDS AND HAS A RECORD. HMMM, WONDER IF U CAN GET A COPY OF HER RECORDS? THEY MAY CALL IT A 50/50, U BOTH WERE AT FAULT, NO POINTS ON U'R INSURANCE.
THE JUDGE MAY SEE SHE IS AT FAULT FOR SPEEDING. DID SHE RECEIVE ANY TICKETS?

depending on what kind of medication she was on, and that she was speeding, you could probably get her found at fault.
