In August I went on a gulet cruise in Turkey which was spoilt by a child being on board the boat. His mother started a relationship with the Captain of the boat, leaving the child to his own devices, which caused disruption to other passengers and raised serious health and safety issues. The Captain also left the boat with the child's mother on a number of occasions, and they spent a considerable amount of time in his cabin. This is my real concern, because his lack of attention was dangerous and caused all passengers problems.

I have sent letters to the companies involved, but am dissatisfied with the lack of response - they are supposed to be ringing me back today.

I now want a full, or at least substantial refund. I have not had to complain about a holiday before so I'm not sure what companies to contact with regard to making a claim.

Thanks to the three of you who have the sense to read beyond what I have written.

For the two of you who've written, frankly ridiculous answers, I'll be very patient:

The child shouldn't have been on the boat because he was under the age limit for the cruise. He caused damage to other people's belongings and hurt several people due to his uncontrolled behaviour. Eight other passengers have also complained. The Captain and the kid's mother being off the boat caused delays to the itinerary and other health and safety scares. The holiday was misrepresented in the brochure.

Not one person on that boat enjoyed the holiday because of the trouble caused. I book Gulet cruises to get away from children - not to be forced into looking after other peoples because they can't be bothered.

I've acted on the advice of those of you who actually talk sense and with all the other details I haven't included here I actually have a very strong case.

Think you will have trouble with this unless you can prove that the Capt of the ship was negligent in his duties and as such this had a negative impact upon the passengers.
The tour company pay for the captain to have a duty of care for their customers which would arise somewhere in the contract that they would have with the cruise company.
Assume that your fellow passengers would act as witnesses and provide statements which would help your case enormously.

In my opinion: 1. The male owner came at you request and probably thought that he was helping you by opening the door with the master key rather than making you get to the door in your chair. I see it as a mistake. 2. If the fridges had broken down, then they needed to transfer the food to somewhere. Your apartment was the quickest and most convenient. They did ask and you said yes. 3. How much notice did you give them for the extra nights? Why didn't you organise the payment when you told them you would be staying longer? 4. Noise. If quietness is such an issue for you, you need to make sure that you check before you book anywhere. 5. Trolley in alley. It might be a fire risk (or might not). I guess you could report your findings to the local authority.

Based on what you have described, the only real course of action would be a dressing down of the captain by the company.
Unless you can illustrate HOW your holiday has been ruined, this claim (in this format) is not likely to succeed.
Collect witnesses if possible...else the only victory will be the price of the boat trip!

we have seen a solicitor about our holiday, we didn't get any where with Thomas cook we been in touch with Irwin Mitchell, or you can try ab ta but that costs, hope this helps.
