I live in New York City with my fiance and she was going to work one morning last week. She got to the train station and a police officer stopped her out of the huge amount of people about to get on the train. They have a little desk area where they check people's bags at random to fight against terrorism. The police officer took her to the table where there were some othe officers as well. He was being flirtatious with her and said in a flirtatious way "we're looking for weapons of mass destruction". He opened her bag and really didn't look inside and they were all just staring at her breast. My Fiance felt really unconfortable and just left really quick and got on the train. I think this is dispicable for people in law enforcement to be abusing their power like this. Do you think we should file a complaint and sue? Do you think she has a valid case? Thank You.

You should certainly complain.

There's no point in attempting litigation unless you have really solid evidence - not just her word against theirs.

You really don't have a lawsuit. But you have a perfectly legitimate complaint. Call the precinct these lousy examples of an otherwise fine profession are from and ask to speak to the commander. Then tell him or her what happened. Chances are, you won't be the only ones complaining and these guys will get disciplinary action.

Your Fiance should tell you the truth.

Regardless, you have nothing to do with this. It is your Fiance's situation and frankly, not a legal one since it's he said, she said.

Based on the total facts in your post, your fiance has no case.

Complain yes, sue no.

In order to file a lawsuit you must be able to prove damages or loss. Loss of time caused by a security check won't be enough and any feeling of discomfort caused by someone LOOKING at her also won't be enough.

If your fiance doesn't want anyone to look at her, she should just stay home.

If you want to waste money on legal fees you will find a lawyer to accomodate you. If you have a problem with people checking out your fiance's breasts you should consider finding a new partner who is flat-chested.
