I am a ship's captain and can say that it's not legal for a ship's captain to marry you aboard ship. The captain of a ship has many rights that no one else in the world has. For example there are only 3 people who are allowed to order a morphine drip. Doctors (of course), army field medics and ship's captains.
That's not saying it doesn't happen legally. There are basically 2 ways a captain can marry a couple. First if the couple is already married (say at town hall) he can perform the ceremony and sign as a witness. Second, this is how some cruise ship companies get around the rules, if he gets registered as a justice of the piece.
The second option is supposedly not much harder than becoming a notary but the captain has to follow state law which usually means the ship needs to be in that state's waters at the time of marriage.

Yes it is legal because the captain of the ship is considered in the law to pronounce marriage between two people who likes to take the bow so to speak. I think it became apparent that in those trying times the shipping industry is the only navigatoral vehicle that cruise and took people from one place to another. And since it became clear that travelling with these kind of vessels is too dangerous, the captain grand marriages of their crew before reaching their destination for obvious reasons, to prove one thing that 'til death do they part.

It's always been legal. It's a long tradition for the Captain of a ship to marry couples while at sea.
